Town Board Minutes 12/18/12

AT THE REGULAR MEETING OF THE TOWN BOARD OF THE TOWN OF NISKAYUNA DULY CALLED AND HELD ON THE 18TH DAY OF DECEMBER, 2012, AT 7:00 PM AT THE NISKAYUNA TOWN BOARD ROOM, ONE NISKAYUNA CIRCLE, NISKAYUNA, NEW YORK, THE FOLLOWING MEMBERS WERE PRESENT;

Julie McDonnell, Councilwoman
Denise Murphy McGraw, Councilwoman
Liz Orzel Kasper, Councilwoman
Jonathan McKinney, Councilman


Others present:  Michele M. Martinelli, Town Clerk; Peter Scagnelli, Town Attorney; Matthew Miller, Deputy Town Attorney; Paul Sebesta, Town Comptroller; Stanley Fiminski, Deputy Chief of Police; Kathy Matern, Planning Technician; William Lawrence, Micro Computer Network Coordinator.

PUBLIC HEARINGS

        A public hearing to consider the application of Domenic Capoccia for a special use permit to allow the manufacturing and bottling of wine at 2820 Balltown Road in the Town of Niskayuna.

        Joe Bianchine  411 Union Street, spoke as a representative of ABD Engineers and Surveyors and explained the process of the Capoccia family own business for producing and bottling of wine.
Leslie Gold, 1919 Pawtucket Ave, stated that it was her understanding that this would be only for manufacturing and bottling of wine and not for sale.

        When no other members of the public wished to be heard, Supervisor Landry closed the Public Hearing.

        A public hearing to consider amending the Code of the Town of Niskayuna limiting the use of bows and crossbows in the Town’s park and recreation areas.  

        Leslie Gold, 1919 Pawtucket Ave, stated that, this is legislation you would think we would not have to enact, but believes that it is a reasonable precaution.

        Paul Burke, Niskayuna resident, has concerns with why we are addressing this issue now.

        When no other members of the public wished to be heard, Supervisor Landry closed the Public Hearing.



RESOLUTIONS

        Resolution 2012-269 authorizes the purchase of computers for use by the Town administrative offices.

        Resolution 2012-270 accepts bids for the purchases of various materials to be used by the Town of Niskayuna in its public works operations during 2013.

        Resolution 2012-271 authorizes the superintendent of highways to use certain lawn mowing and trimming services for the Dean Street and Baker Avenue Parks and certain holding ponds.

        Resolution 2012-272 schedules a public hearing and make a determination on SEQR for an application for a special use permit at 2303 & 2309 Nott Street East.
Supervisor Landry announced that the public hearing will take place on January 10, 2013.

        Resolution 2012-273 authorizes the supervisor to enter in to a contract with the Animal Protective Foundation of Schenectady Inc. for the impounding and care of dogs during 2013.

        Resolution 2012-274 authorizes the supervisor to enter in to an authorization and consent agreement.

        Resolution 2012-275 makes certain budget modifications.

Resolution 2012-276 appoints a person to the position of building inspector.

Resolution 2012-277 authorizes the supervisor to extend an inter-municipal agreement for the disposal of sewage sludge for on (1) year, January 1, 2013 through December 31, 2013.

Resolution 2012-278 authorizes the supervisor to execute a memorandum of agreement with the Town of Niskayuna highway and parks bargaining unit.

Resolution 2012-279 authorizes a modification to the fee schedule associated with the impoundment of vehicles.

Resolution 2012-280 authorizes the supervisor to enter in to a lease termination agreement and general release.

Resolution 2012-281 authorizes the purchase of a new police vehicle for use by the Town’s police department.

Resolution 2012-282 declines to accept bids for the Grange Hall project.

Resolution 2012-283 authorizes transfer of section 8 recovery account funds.

Resolution 2012-284 authorizes the carry-over of vacation time by employees of the water and sewer department and highway department.

Resolution 2012-285 employs additional persons in the Town’s water and sewer department and highway department.

Resolution 2012-286 amends a Resolution adopting a salary schedule.

Resolution 2012-287 adopts a salary schedule.

Intrduction of Proposed Local Law No. H (2012)

        Resolution 2012-288 calls for a public hearing to amend chapter 17 of the code of the Town of Niskayuna entitled ethics.

        Resolution 2012-289 standardizes the Purchas of fire hydrants.

        Resolution 2012-290 authorizes the supervisor to enter into an agreement to permit construction of a fence within a portion of a town easement.

        Resolution 2012-291 accepts bids for the purchase of various materials to be used by the Town of Niskayuna in its public works operations during 2013.

        Resolution 2012-292 authorizes the renewal of a contract for professional services for a regulatory financial statement audit.

        Resolution 2012-293 appoints a person to a position in the Office of Community Programs.

        There being no further business to come before the board, Supervisor Landry adjourned the meeting.
