The Zoning Board of Appeals of the Town of Niskayuna will conduct a regular meeting on WEDNESDAY, May 15, 2013 at 7:00 P.M. in the Town Board Meeting Room, Town Hall, One Niskayuna Circle, Niskayuna, New York to consider the following matters:


1. The appeal of Richard Romer,1026 Lamplighter Road, Niskayuna, New York, for a variance from Section 220-18 B (3)(c) of the Zoning Ordinance of the Town of Niskayuna for the construction of a 10’ X 12’ shed on the property noted above.  The property is located in the R-1: Low Density Residential Zoning District.  Accessory Structures:  Section 220-18 B (3)(c) states that minor accessory structures, which are defined as those less than 120 square feet in area, are not permitted closer than five (5) feet to the side or rear lot lines.  As proposed, your shed will be located two (2) feet from the rear property line.  Therefore; a three (3) foot rear yard setback variance is required.

2. The appeal of Alan Clarke, 1177 South Country Club Drive, Niskayuna, New York, for a variance from Section 220-13 Schedule I-C of the Zoning Ordinance of the Town of Niskayuna, for the installation of a 15’ X 25’ above ground pool (327 square feet) on the property noted above.  The property is located in the R-2: Medium Density Residential Zoning District.
Section 220-18 B (3)(b) states that “the required side and rear yard dimensions for major accessory structures shall be the same as applies to the principal building”.  Major accessory structure is defined as “detached accessory buildings or structures in excess of 120 square feet”.  Your pool, at 327 square feet, is a major accessory structure.  Section 220-13 Schedule I-C establishes the side setback requirement as fifteen feet (15’).  As proposed, the pool would be located three feet (3’) from the side property line.  Therefore, a twelve foot (12’) side yard setback variance is required.

3. The appeal of Matthew Loiselle, 2192 Grand Boulevard, Niskayuna, New York 12309, for variances from Section 220-13 Schedule I-C of the Zoning Ordinance of the Town of Niskayuna for the installation of an 18’ X 20’ (360 square feet) garage on the property noted above.  The property is located in the R-2: Medium Density Residential Zoning District. Accessory Structures: Section 220-18 B (3)(b) states that “the required side and rear yard dimensions for major accessory structures shall be the same as applies to the principal building”.  A major accessory structure is defined as “detached accessory buildings or other structures in excess of 120 square feet”.  Your garage, at 360 square feet, is a major accessory structure.  Section 220-13 Schedule I-C establishes the side setback requirement as fifteen feet (15’) and the rear setback requirement as twenty feet (20’).  As proposed, the garage would be located four feet three inches (4’3”) from the side property line and five feet six inches (5’6”) from the rear property line.  Therefore; both, a ten foot nine inch (10’9”) side yard setback variance and a fourteen foot six inch (14’6”) rear yard setback variance are required.








4.  The appeal of Nicholas Vance, 1430 Van Antwerp Road, Niskayuna, New York, for a variance from Section 220-13 Schedule I-B of the Zoning Ordinance of the Town of Niskayuna for the application to maintain a 22’X 21’ (462 square feet) shed on the property noted above.  The property is located in the R-1: Low Density Residential Zoning District.
Number of Permitted Structures: Section 220-18 B (2) states that “there shall not be more than three accessory structures on a lot if one of the accessory structures is a fence; otherwise, there shall not be more than two accessory structures on a lot”. There are two (2) existing accessory structures on the property; a gazebo and a shed.  The carport creates a total of three (3) accessory structures.  Therefore, a variance from this section is required. Accessory Structures: Section 220-18 B (3)(b) states that “the required side and rear yard dimensions for major accessory structures shall be the same as applies to the principal building”.  A major accessory structure is defined as “detached accessory buildings or other structures in excess of 120 square feet”.  Your carport, at 462 square feet, is a major accessory structure.  Section 220-13 Schedule I-B establishes the side setback requirement as twenty feet (20’).  As constructed, the carport would be located five feet (5’) from the side property line.  Therefore, a fifteen foot (15’) side yard setback variance is required.
